1. Introduction

Welcome to LiveFuse ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of LiveFuse's website, services, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Account Registration

To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

3. User Content

Our Services may allow you to create, upload, post, send, receive, and store content. You retain ownership of any intellectual property rights that you hold in that content. When you upload, post, send, receive, create, or store content, you give us permission to use that content solely for the purpose of providing our Services.

4. Widget Marketplace

Our Services include a marketplace where developers can offer widgets for use by streamers. When you purchase widgets from our marketplace, you're purchasing a license to use the widget, not ownership of the widget itself. The terms of each license will be specified at the time of purchase.

If you are a developer selling widgets through our marketplace, you are responsible for ensuring that your widgets comply with these Terms and all applicable laws and regulations.

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Services for any illegal purpose or in violation of any laws
• Posting or transmitting viruses, malware, or other harmful code
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services
• Collecting or harvesting any information from the Services, including user accounts
• Using the Services in any manner that could disable, overburden, damage, or impair the site
• Using any robot, spider, or other automated means to access the Services
• Using the Services to send spam or other unsolicited communications

6. Payments and Subscriptions

Certain aspects of the Services may require payment or a subscription. All payments are processed through our third-party payment processors. By providing payment information, you represent and warrant that you are authorized to use the payment method provided.

Subscriptions will automatically renew for successive periods equal to your initial subscription period unless you cancel your subscription before the end of the current period. You may cancel your subscription at any time through your account settings.

7. Intellectual Property

The Services and its original content, features, and functionality are and will remain the exclusive property of LiveFuse and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of LiveFuse.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

IN NO EVENT WILL LIVEFUSE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Indemnification

You agree to defend, indemnify, and hold harmless LiveFuse, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

11. Governing Law

These Terms and your use of the Services will be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule.

12. Changes to These Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Services thereafter. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.
